www.thebirthcompany.co.uk is the trading name of The Birth Company Limited, registered in England with company number04002140. Our registered office is 2 Cavendish Square, London, W1G 0PU.

References here to www.thebirthcompany.co.uk , “we”, “us”, “our” are references to “The Birth Company”. References to “Customer”, “you”, “yours” are references to the customer placing an order under the Website. A reference to “Product(s)” means product(s) ordered by you from the Website.

Appointments and cancellations

• All administrative staff, sonographers and doctors at “The Birth Company” are trained and approved in accordance with the company’s treatment protocols and therefore “The Birth Company” does not guarantee continued treatment with a named sonographer or doctor.
• If you are unable to attend your appointment, we require 24 hours’ notice. Failure to give the required notice will result in you being charged a cancellation fee of £50.
• Please arrive for your appointment at least 10 minutes in advance so that the necessary paperwork can be completed. Late arrival may result in reduced treatment time or forfeiting of the appointment. The Birth Company will endeavour to ensure that your appointment runs to time; however, should we need to cancel or postpone your appointment at short notice, we will make every effort to contact you in advance.
• Prior to your appointment we will inform you of any preparation required in advance of your treatment. Failure to follow the guidelines may result in cancellation of your appointment, reduced treatment time, or additional fees being charged.

Liability to You

The Birth Company cannot accept any liability for a failure to comply with specific instructions on the Website or in any brochure issued by The Birth Company. Customers’ statutory rights are not affected by this statement.

We are not responsible to a Customer for indirect losses which happen as a side effect of the main loss or damage (such as loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time) however arising and whether cause by tort (including negligence), breach of contract or otherwise.

Security

You are solely responsible in all respects for all use of and for protecting the confidentiality of any username, e-mail verification and password that may be given to you or selected by you for use on our website. You may not share these with or transfer them to any third parties. You must notify us immediately of any unauthorised use of them or any other breach of security regarding our website that comes to your attention.

13.3 These terms and conditions together with the privacy policy, any order form and payment method instructions, if any, are the whole agreement between you and us. You acknowledge that you have not entered into this agreement in reliance upon any statement, warranty or representation made by us or any other person and you irrevocably and unconditionally waive any rights to claim damages and/or to rescind these terms and conditions by reason of any misrepresentation (other than a fraudulent misrepresentation) that is not contained in the terms and conditions, privacy policy, order form and payment method instructions.

13.4 If any provision or term of these terms and conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other terms and conditions and shall be deemed to be deleted from them.

13.5 These terms and conditions and your use of our website are governed by English law and you submit to the non-exclusive jurisdiction of the English court.

13.6 Except in respect of a payment obligation, neither you nor we will be held liable for any failure to perform any obligation to the other due to causes beyond your or Company Name’s respective reasonable control.

Notice will be deemed received when an e-mail is received in full (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt) or 3 days after the date of posting.

• We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business and our goods, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.
